By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or country of residence, and that you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our store is correct, current, and complete, and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

We have made every effort to provide an accurate representation of our products in our online store. However, please note that colors or product appearance may differ from how they appear on your screen due to the device you use to access the store and your device's settings and configuration.

All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products we offer to any person, geographic region, or jurisdiction, on a case-by-case basis.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Clive and Bacon reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Clive and Bacon confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted except where you have a statutory right to cancel — see Section 22 for cancellation rights available to UK and EU customers. If we do not accept, change, or cancel an order, we will attempt to notify you using the email, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export, unless you are purchasing as an approved wholesale account under a separate wholesale agreement with us.
SECTION 4 - PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, duties, shipping, handling, customs, or import charges — international customers, including those in the UK and EU, may be charged customs duties or import VAT by their local carrier or customs authority on delivery, separately from what we charge at checkout.
Prices posted in our online store may differ from prices offered elsewhere. We may run promotions governed by separate terms; if there's a conflict between promotion terms and these Terms, the promotion terms govern.
You agree to provide current, complete, and accurate purchase, payment, and account information, and to promptly update it, including your email address and card details, so we can complete your transactions and contact you as needed.
You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are duly authorized to use that payment method, (iii) charges incurred by you will be honored by your card issuer, and (iv) you will pay charges incurred at the posted prices, including shipping, handling, and applicable taxes.
SECTION 5 - SHIPPING AND DELIVERY
All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you. This does not affect any statutory right you may have, as a UK or EU consumer, to a remedy if goods are not delivered within a reasonable time or the agreed timeframe (see Section 22).
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and their design, selection, and arrangement, are owned by Clive and Bacon, its affiliates, or licensors, and are protected by U.S. and foreign patent, copyright, and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on the Services without our prior written consent. Nothing in these Terms grants any license or other rights under any patent, trademark, copyright, or other intellectual property of Clive and Bacon, Shopify, or any third party, except as expressly provided. Unauthorized use of the Services may violate federal and state intellectual property laws. All rights not expressly granted are reserved by Clive and Bacon.
Clive and Bacon's names, logos, product and service names, designs, and slogans are trademarks of Clive and Bacon or its affiliates or licensors. You must not use these trademarks without our prior written permission. Shopify's name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, and marks on the Services belong to their respective owners.
SECTION 7 - OPTIONAL TOOLS
You may be given access to customer tools offered by third parties as part of the Services, which we neither monitor nor control. We provide access to such tools "as is" and "as available," without warranties of any kind and without endorsement. We have no liability arising from your use of optional third-party tools. Any use of these tools is entirely at your own risk, and you should review the relevant third-party provider's own terms. New features we introduce in the future are also part of the Services and subject to these Terms.

The Services may contain materials and links to third-party websites (including embedded third-party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites. If you leave the Services to access third-party sites, you do so at your own risk. We are not liable for any harm related to your access to, or purchases from, third-party websites. Direct any complaints about third-party products or services to that third party.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Clive and Bacon is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Clive and Bacon. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Clive and Bacon, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Clive and Bacon.
SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services to provide and improve the Services. You represent and warrant that: (i) you own or have all necessary rights to your Feedback; (ii) you have disclosed any compensation received in connection with it; and (iii) it complies with these Terms. We are under no obligation to keep Feedback confidential, pay for it, or respond to it. We may, but have no obligation to, monitor, edit, or remove Feedback we determine to be unlawful, offensive, or otherwise objectionable. You are solely responsible for your Feedback and its accuracy.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on the Services containing typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct these and to update or cancel orders if information is inaccurate, even after you've submitted an order, subject to any statutory rights described in Section 22.

You may access and use the Services for lawful purposes only. You may not: (a) use the Services for any unlawful or malicious purpose; (b) violate any applicable regulations or laws; (c) infringe our or others' intellectual property rights; (d) harass, abuse, or harm any person; (e) transmit false or misleading information; (f) send material that doesn't comply with these Terms; (g) send unsolicited advertising ("spam"); (h) impersonate any person or entity; or (i) engage in conduct that restricts or inhibits others' use of the Services or may expose us or Shopify to liability.
You also agree not to: (a) upload viruses or malicious code; (b) reproduce, extract, sell, or exploit any portion of the Services; (c) collect or track others' personal information; (d) spam, phish, or pretext the Services; (e) use bots, scrapers, data-extraction tools, or AI/agentic tools to access the Services other than as permitted under Section 14; or (f) interfere with, bypass, or circumvent our security or access-control measures. We may suspend, disable, or terminate your account at any time without notice if we determine you've violated these Terms.

This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, and that can be executed on a person's behalf or using their device without direct supervision.
No Agent may access, use, or interact with the Services unless it identifies itself and operates in strict accordance with the requirements below, and unless we have not requested that it refrain from doing so. We may limit, including through technical measures, whether and how any Agent accesses the Services.
Agents must: (i) identify themselves in all HTTP/HTTPS requests by including "Agent/[agent name]" in the request's user agent string; (ii) not conceal or obfuscate that access is from an Agent, including by mimicking human behavior or bypassing CAPTCHAs; (iii) respond truthfully to any question seeking to determine whether an interaction is from a human or a computer; and (iv) not circumvent any measure intended to control how Agents access or use the Services.

We may terminate this agreement or your access to the Services, in our sole discretion, at any time without notice, and you will remain liable for all amounts due up to the date of termination.
The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive.
SECTION 16 - DISCLAIMER OF WARRANTIES
Information presented on the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information, and any reliance you place on it is at your own risk.
EXCEPT AS EXPRESSLY STATED BY CLIVE AND BACON, OR AS REQUIRED BY LAW (SEE SECTION 22 FOR RIGHTS THAT APPLY TO UK AND EU CONSUMERS), THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THIS MAY NOT APPLY TO YOU.
SECTION 17 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, CLIVE AND BACON, LLC, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, EVEN IF ADVISED OF THEIR POSSIBILITY.
NOTHING IN THIS SECTION EXCLUDES OR LIMITS OUR LIABILITY WHERE IT WOULD BE UNLAWFUL TO DO SO — including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any statutory rights of consumers that cannot be excluded or limited under the law of your country of residence, including the United Kingdom and European Union (see Section 22).
SECTION 18 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Clive and Bacon, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, arising out of (1) your breach of these Terms, (2) your violation of any law or third-party right, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim; a failure to promptly notify will not relieve your obligations unless you are materially prejudiced. We may control the defense and settlement of such a claim at your expense, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims.
SECTION 19 - SEVERABILITY
If any provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full effect.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms does not waive that right or provision. These Terms and any policies posted by us constitute the entire agreement between you and us regarding the Service, superseding any prior agreements or communications, whether oral or written.
SECTION 21 - ASSIGNMENT
You may not delegate, transfer, or assign this agreement or your rights or obligations under these Terms without our prior written consent; any such attempt is null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without your consent or notice.
SECTION 22 - INTERNATIONAL CUSTOMERS: UK AND EU CONSUMER RIGHTS
We sell to customers outside the United States, including in the United Kingdom and European Union. Nothing in these Terms is intended to limit, exclude, or override any statutory right you have as a consumer under the law of the country where you live, to the extent that law applies to your purchase and cannot lawfully be excluded by agreement.
In particular, if you are a consumer in the UK or EU purchasing at a distance (online):

Cancellation right: You generally have the right to cancel your order within 14 days of receiving your goods, without giving a reason, under the UK Consumer Contracts Regulations 2013 (or the equivalent EU Consumer Rights Directive implementation in your country). See our Refund Policy for how to exercise this.

Personalized items exception: This 14-day cancellation right does not apply to goods made to your specifications or clearly personalized for you — for example, bandanas or accessories customized with a pet's name or a custom design. These remain subject to our standard Refund Policy for faults or errors on our part.

Faulty or misdescribed goods: If an item you receive is faulty, not as described, or otherwise doesn't meet the standards required under the UK Consumer Rights Act 2015 or equivalent EU law, you have a right to a repair, replacement, price reduction, or refund, regardless of the cancellation exception above.
These rights apply in addition to, and are not limited by, anything else in these Terms, including Sections 3, 5, 16, and 17.
SECTION 23 - GOVERNING LAW
These Terms of Service, and any separate agreements whereby we provide you Services, are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-law principles. You and Clive and Bacon consent to the exclusive jurisdiction and venue of the state and federal courts located in Yolo County, California.
If you are a consumer resident in the United Kingdom or European Union, this choice of law does not deprive you of the protection of any mandatory consumer-protection provisions of the law of your country of residence, and you may also be entitled to bring proceedings in the courts of your own country.

The headings used in this agreement are included for convenience only and do not limit or otherwise affect these Terms.
SECTION 25 - CHANGES TO TERMS OF SERVICE
You can review the most current version of these Terms at any time on this page. We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website. We will notify you of material changes in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
